Federal Tax Update 2023:

Happy New Year! Review (or become acquainted with) developments in federal taxation that affect 2022 returns and planning for 2023, including tax legislation and other significant developments.

Estate Plans in Action:

Implementing the trustors’ (and estate planner’s) vision. Managing challenging assets, challenging personalities, and challenging market forces.

Dealing with Uncle Sam, Everyone's Least Favorite Relative in the Family Business:

Exploring the tax and estate planning implications of closely held business interests and the strategic income tax decisions that should be considered in light of possible or actual changes in business taxation.

I Think I Remember You:

Dementia should not prevent entering into or end a legal or professional relationship. But it does heighten our ethical obligations. We explore the practical and ethical implications of assessing and understanding client capacity.

Maybe We Can Help:

When a client does have some cognitive issues, steps can be taken to accommodate them. We’ll explore how dementia changes understanding, communication, and behavior, and gain insights into providing dementia-informed services.

 

About Samuel A. Donaldson,

Samuel A. Donaldson, JD, LLM, is a professor at Georgia State University College of Law in Atlanta. A popular speaker on federal income, estate, and gift taxes and the author of numerous books, he teaches courses in taxation, estate planning, property, and professional responsibility. Prof. Donaldson is an Academic Fellow of the American College of Trust and Estate Counsel, and a member of the bar in Washington, Oregon, and Arizona. He has a bachelor’s degree from Oregon State University, a Master of Laws from the University of Florida, and a Juris Doctor degree from the University of Arizona. Donadlson co-authored the Federal Income Tax: A Contemporary Approach casebook and the Price on Contemporary Estate Planning treatise. Prof. Donaldson is also an amateur crossword constructor, and his puzzles have been published in outlets including The New York Times, The Washington Post, and The Wall Street Journal.

About Shelly Donaldson

Shelly Donaldson is Vice President and Business Development Officer at Cumberland Trust in Atlanta. Prior to joining Cumberland Trust, Donaldson was a practicing attorney with experience in estate planning for high-net-worth clients and families with a focus on tax planning, real estate, closely held business entities, and special needs planning. Donaldson served on the Executive Committee of the Georgia Bar Association Fiduciary Law Section and was a past chair of the Atlanta Bar Estate Planning and Probate Section. Donaldson is also a past board member of The Bobby Dodd Institute, a nonprofit that helps individuals living with a disability succeed at work, in the community, and in life.

About David Godfrey

David Godfrey, JD, is Director of the ABA Commission on Law and Aging in Washington, DC. He is responsible for managing the research, training, and policy work of the Commission. Prior to joining the Commission, he was responsible for elder law programming at the Access to Justice Foundation in Kentucky. Mr. Godfrey earned his B.A. with honors at Rollins College in Winter Park, Florida, and his J.D. cum laude from the University of Louisville School of Law in Kentucky. He served on the board of the National Academy of Elder Law Attorneys and was named a Fellow of the Academy in 2019.
